IMM 5409 – Statutory Declaration of Common-Law Union

The IMM 5409 is a statutory declaration form that must be completed and signed with handwritten signatures to confirm a common-law partnership when required by your immigration application. It is often used for family sponsorship or other immigration streams where proof of a conjugal relationship is needed.
Who Must Complete This Form
This form must be completed by both partners in the following situations:
- If you are sponsoring a family member and your common-law partner is a co-signer on the application;
- If the principal applicant (the person you are sponsoring or the one applying for permanent residence) has a common-law partner;

Completing the Form
The form includes sections to fill in basic information about both partners and their declaration of a common-law relationship. It asks for:
- Country and place of current residence;
- Names of both partners as shown on passports or travel documents;
- Duration and details of the conjugal relationship (continuous years and dates);
- Joint financial or property arrangements, such as shared lease/mortgage/ownership, joint bank or credit accounts;
- Evidence of the relationship (insurance beneficiary designations, other documentation).
If you answered “no” to questions on joint documentation, you are asked to provide other documentary evidence showing your relationship.
Signing the Declaration
The statutory declaration must be signed in the presence of a person authorized to administer oaths (for example, a notary public). Both partners sign the declaration, and the administrator must also sign and provide their title.
